1. Agreement to Terms

By accessing or using Andorius ("the Service"), operated at andorius.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. The Service

Andorius is a meditation and ambient sound platform that provides:

• Sound Library — A curated collection of meditation soundscapes and ambient audio
• moonMind — A noise layer generator with white, pink, and brown noise, plus Soundscapes channels and saveable presets
• moonVibe — A breath-synchronized music experience that responds to your breathing patterns
• moonFlow — A combined breath-responsive audio and noise layer mixing environment

3. Accounts

• You must be at least 16 years of age to create an account and use the Service.
• You must provide accurate and complete information when creating your account.
• You are responsible for keeping your sign-in credentials secure and confidential.
• Each person may maintain only one account. Creating multiple accounts to circumvent usage limits or for any other purpose is prohibited.
• You are responsible for all activity that occurs under your account.

4.3 Billing Terms

• Paid plans are billed monthly through Stripe.
• You can cancel your subscription at any time from your Account page. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial billing periods unless required by applicable law.
• Prices may change with 30 days advance notice.

5. Usage Limits

• Each plan includes a daily playback minute allowance as listed above.
• Usage limits reset daily at midnight (UTC).
• Tracks marked as "Free" in the Sound Library are always available without limits, regardless of your plan.
• Exceeding your daily limit will pause premium playback until the next reset.

6. Acceptable Use

You agree not to:

• Redistribute, re-upload, or resell any audio content from the Service
• Abuse, overload, or interfere with the Service's API or infrastructure
• Attempt to bypass, circumvent, or manipulate usage limits or billing
• Use automated tools, bots, scrapers, or crawlers to access or extract content from the Service
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate another person or entity, or misrepresent your affiliation

7. Intellectual Property

• All sounds, music, audio content, user interface designs, logos, and branding on the Service are the property of Andorius or its licensors and are protected by copyright and intellectual property laws.
• User-created presets, configurations, and saved settings remain the property of the user who created them.
• By using the Service, you are granted a limited, non-exclusive, non-transferable license to stream audio content for personal, non-commercial use.

8. Termination

• We may suspend or terminate your account if you violate these Terms of Service.
• We may suspend accounts that show patterns of abuse, such as repeated limit circumvention or automated access.
• You may delete your account at any time from your Account page. Account deletion is permanent and cannot be reversed.
• Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may perform maintenance, updates, or modifications that temporarily affect availability.

Andorius is a meditation and sound tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Andorius and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service is limited to the total amount you have paid to Andorius in the 12 months preceding the claim.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Greece and applicable European Union regulations, including the GDPR. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

12. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will provide at least 30 days advance notice by email or through a notice on the Service. Continued use of the Service after the effective date of changes constitutes acceptance of the updated terms.
